Terms and Conditions for Tour Bookings

These Terms and Conditions apply to bookings of tours, activities and experiences offered by:

1. Scope

These Terms and Conditions apply to all tours, activities and experiences booked directly with Bavaroona Tours UG (haftungsbeschränkt), including bookings made through bavaroona.com and booking.bavaroona.com.

For bookings made through third-party platforms such as GetYourGuide, the terms and conditions of the respective platform may additionally apply.

The specific description of the selected tour, including date, time, duration, price and included services, forms part of the booking contract.

2. Contract Formation

The presentation of tours and activities on our websites does not constitute a legally binding offer.

By completing the booking process and submitting a booking, you make a binding offer to enter into a contract for the selected tour.

The contract is concluded once Bavaroona confirms the booking, usually by email.

Please check the information provided during the booking process carefully before submitting your booking.

You are responsible for providing a valid email address and accurate contact information so that we can send you booking confirmations and important information relating to your tour.

3. Prices and Payment

The price applicable to a booking is the price displayed during the booking process at the time the booking is submitted.

All prices displayed to consumers are total prices and include applicable taxes unless expressly stated otherwise.

Payment is made using the payment methods offered during checkout.

Payments may be processed by our payment service provider Stripe.

A booking may only be considered fully confirmed once any payment required at the time of booking has been successfully completed.

4. Cancellation by the Customer

Customers may cancel their booking free of charge up to 48 hours before the scheduled start time of the tour.

Where a booking is cancelled more than 48 hours before the scheduled start time, Bavaroona will refund the amount paid for the cancelled booking.

For cancellations made less than 48 hours before the scheduled start time, the full booking price is payable and no regular refund will be issued.

The same applies in the event of a no-show.

However, the customer remains expressly entitled to demonstrate that Bavaroona suffered no loss or a substantially lower loss as a result of the cancellation or no-show.

Unless otherwise agreed, refunds are made to the original payment method.

The relevant time for determining whether the 48-hour cancellation period has been met is the scheduled local start time of the tour in Munich.

5. Changes to a Booking

Requests to change a booking, including changes to the tour date, start time or number of participants, are subject to availability.

Where possible, we will try to accommodate reasonable change requests made more than 48 hours before the tour.

There is no automatic entitlement to a change of booking.

A requested change is only effective once it has been confirmed by Bavaroona.

Price differences resulting from a change of date, tour or number of participants may be charged or refunded accordingly.

6. Late Arrival and No-Shows

Customers are responsible for arriving at the communicated meeting point on time.

We recommend arriving at least 10 minutes before the scheduled start time.

Tours may need to begin on time in order to comply with reservations, opening hours, schedules and commitments to other participants.

If you arrive late, we cannot guarantee that you will be able to join the tour.

A late arrival that prevents participation is generally treated as a no-show.

If you realise that you will be late, please contact Bavaroona as soon as possible using the contact information provided in your booking confirmation.

7. Cancellation or Changes by Bavaroona

Bavaroona reserves the right to cancel, interrupt or reasonably modify a tour where this becomes necessary due to circumstances such as:

  • safety concerns;

  • severe weather conditions;

  • illness or unexpected unavailability of a guide;

  • official orders or restrictions;

  • closure or restricted access to locations included in the tour;

  • events outside our reasonable control;

  • other circumstances that make performance of the tour impossible, unsafe or unreasonable.

If Bavaroona cancels a tour before it begins and no suitable alternative can be offered and accepted, the customer will receive a refund of the amount paid to Bavaroona for the affected tour.

Where possible, we may alternatively offer another date or comparable tour.

Reasonable changes to the route, sequence, guide, meeting point or individual stops may be made where necessary, provided that the overall character and essential value of the booked experience are not materially reduced.

Statutory rights of the customer remain unaffected.

8. Third-Party Venues and Locations

Some Bavaroona tours include visits to third-party locations such as restaurants, beer halls, breweries, markets, festival grounds or beer tents.

These locations are operated independently from Bavaroona and may be subject to their own:

  • opening hours;

  • admission rules;

  • security requirements;

  • age restrictions;

  • house rules;

  • capacity restrictions;

  • availability;

  • operational changes.

Participants must comply with the lawful rules and instructions of the respective venue.

Where circumstances outside Bavaroona's control require reasonable changes to an itinerary, Bavaroona may substitute a comparable location or adjust the sequence of the tour where appropriate.

9. Oktoberfest Tours

For Oktoberfest tours, access to the festival grounds, beer tents and other venues is additionally subject to the official rules of the Oktoberfest, the City of Munich, the respective festival operators and individual beer tent operators.

Security measures, admission procedures, opening hours and access rules may change at short notice.

Only those services expressly stated as included in the relevant Oktoberfest tour description and booking confirmation form part of the contract.

Any food, beverages, reservations, seating arrangements or other services are included only where they are expressly listed as included in the booked product.

Customers must comply with all applicable Oktoberfest and beer tent rules.

10. Alcohol and Conduct

Some Bavaroona experiences involve visits to locations where alcoholic beverages are served.

Participants are responsible for consuming alcohol responsibly.

Alcohol will only be served in accordance with applicable law and the rules of the respective venue.

Participation in a tour does not create an entitlement to be served alcohol.

Bavaroona or the relevant venue may refuse or discontinue the service of alcohol where required by law or where appropriate for safety reasons.

Participants must behave respectfully towards guides, other participants, venue staff and members of the public.

Bavaroona may exclude a participant from a tour where the participant:

  • behaves aggressively or abusively;

  • threatens the safety of others;

  • seriously disrupts the tour;

  • deliberately damages property;

  • refuses to comply with reasonable safety instructions;

  • is so intoxicated that safe participation is no longer reasonably possible.

Where exclusion results from the participant's own serious misconduct, there is generally no entitlement to a refund.

11. Children and Minors

Any minimum age or age-related requirements specified in the relevant tour description apply.

Children and minors must be supervised as required by applicable law and the individual tour conditions.

The serving and consumption of alcoholic beverages is subject to German law and the rules of the respective venue.

Where a tour includes alcoholic beverages, participants who are not legally permitted to consume the relevant beverage are not entitled to receive alcohol.

12. Customer Responsibilities

Participants are responsible for:

  • arriving at the correct meeting point on time;

  • providing accurate booking and contact information;

  • checking booking confirmation details;

  • following reasonable instructions provided by guides;

  • complying with applicable laws and venue rules;

  • wearing clothing and footwear appropriate for the tour and weather;

  • informing Bavaroona in advance of circumstances that may materially affect participation where relevant.

Customers are responsible for assessing whether a tour is suitable for their personal circumstances.

Questions regarding accessibility or specific participation requirements should be directed to Bavaroona before booking where possible.

13. Weather

Unless otherwise stated, Bavaroona tours generally take place in a variety of weather conditions.

Normal rain, heat, cold or other typical weather conditions do not automatically result in cancellation.

Participants are responsible for bringing appropriate clothing and protection for the expected conditions.

Where weather conditions create a genuine safety risk or make the tour unreasonable to perform, Bavaroona may cancel or modify the tour in accordance with Section 7.

14. Personal Belongings

Participants are responsible for their personal belongings during the tour.

Bavaroona is not responsible for lost, forgotten or stolen property unless Bavaroona is legally liable for the loss.

If property is found after a tour, we will make reasonable efforts to help return it to its owner.

Any reasonable shipping or delivery costs may be charged to the customer.

15. Liability

Bavaroona is liable without limitation for:

  • damage resulting from intentional or grossly negligent conduct;

  • damage resulting from injury to life, body or health caused by a negligent or intentional breach of duty;

  • liability arising under mandatory statutory provisions.

In cases of simple negligence involving the breach of an essential contractual obligation, Bavaroona's liability is limited to the damage that was foreseeable and typical for this type of contract.

An essential contractual obligation is an obligation whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may reasonably rely.

Any further liability for simple negligence is excluded to the extent permitted by law.

These limitations also apply in favour of Bavaroona's legal representatives, employees, guides and agents to the extent permitted by law.

Nothing in these Terms and Conditions limits any liability that cannot legally be limited or excluded.

16. Services Provided by Independent Third Parties

Where individual services are clearly provided by independent third parties, their own terms and legal responsibilities may apply to those services.

Bavaroona remains responsible for its own contractual obligations towards the customer.

Nothing in these Terms and Conditions excludes statutory rights relating to services that form part of the contract with Bavaroona.

17. Right of Withdrawal

The tours and experiences offered by Bavaroona are leisure services provided on a specific date or during a specific period.

For such contracts, consumers generally do not have the statutory 14-day right of withdrawal applicable to many other distance contracts.

The contractual cancellation rights set out in Section 4 remain unaffected.

18. Intellectual Property

Content provided by Bavaroona, including tour concepts, texts, images, branding and other materials, is protected by applicable intellectual property laws where relevant.

Customers may use materials provided to them for their personal purposes but may not commercially reproduce or distribute protected Bavaroona content without permission.

19. Data Protection

Personal data is processed in accordance with our current Privacy Policy.

The Privacy Policy is available on bavaroona.com and applies to the processing of personal data in connection with direct bookings through our websites.

20. Complaints and Customer Support

If you experience a problem with your booking or tour, please contact us as soon as possible so that we have an opportunity to resolve the issue.

Where a problem occurs during a tour and can reasonably be corrected at that time, participants are encouraged to inform the guide immediately.

21. Consumer Dispute Resolution

Bavaroona Tours UG (haftungsbeschränkt) is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

22. Applicable Law

These Terms and Conditions and the contractual relationship between Bavaroona and the customer are governed by the laws of the Federal Republic of Germany.

For consumers, this choice of law does not deprive them of mandatory consumer protection rights that apply under the law of the country in which they have their habitual residence where such rights cannot legally be excluded by agreement.

23. Jurisdiction

For consumers, the statutory rules on jurisdiction apply.

Where the customer is a merchant, a legal entity under public law or a special fund under public law, Munich shall be the place of jurisdiction to the extent permitted by law.

24. Severability

If an individual provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions remains unaffected.

The invalid or unenforceable provision shall be replaced by the applicable statutory provision.

25. Changes to These Terms

The version of these Terms and Conditions in effect at the time of the booking applies to that booking.

Bavaroona may update these Terms and Conditions for future bookings where necessary.

Changes do not retroactively alter an already concluded booking contract unless expressly agreed with the customer or required by law.
